1. Agreement to these Terms
These Terms of Service ("Terms") are an agreement between you and ExceedX AI, provider of Moli ("Moli," "we," "us," or "our"). They govern your use of the Moli iOS app, website, and related services (the "Service").
By creating an account, using Moli, starting a subscription, or accepting these Terms, you agree to be bound by them and by our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and parent responsibility
Moli is for parents and legal guardians. You must be at least 18 years old, or the age of legal majority where you live, to create an account. You are responsible for your account, for any child profiles you create, and for supervising a child's use of Moli.
You represent that you have the legal authority to provide any child information, prompts, voice recordings, or other content you submit to Moli, and to provide the consents requested in the app.
3. Accounts and security
You agree to provide accurate account information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly if you believe your account has been compromised.
We may refuse, suspend, or terminate accounts that violate these Terms, create risk for children or families, harm the Service, or expose us or others to legal liability.
4. The Moli Service
Moli helps parents generate personalized, age-appropriate stories, cover art, and narration for children. Features may vary by account type, subscription status, device, location, provider availability, and app version.
We may change, add, remove, suspend, or discontinue features at any time. We try to keep Moli reliable and delightful, but we do not guarantee that the Service will always be available, error-free, uninterrupted, or that every generated story will meet your expectations.
5. Content and ownership
"User Content" means information you submit to Moli, including prompts, child profile details, interests, and voice recordings. You keep any rights you have in your User Content. You grant Moli a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, reproduce, modify, and create derivative works from User Content only as needed to provide, secure, support, and improve the Service and as described in our Privacy Policy.
Subject to these Terms and applicable law, generated stories and story media created for your account may be used by your family for personal, non-commercial purposes. Moli and its licensors retain all rights in the app, software, designs, models, systems, templates, prompts, safety controls, names, marks, and other Service technology.
You are responsible for making sure your prompts and other User Content do not infringe others' rights, violate law, or include content you are not authorized to provide.
6. AI-generated content and safety
Moli uses automated systems and third-party AI providers to generate and narrate stories. We use safety prompts, prompt screening, output checks, age-appropriate constraints, rate limits, and parent consent gates. Even with these protections, AI output can be imperfect, unexpected, inaccurate, repetitive, or inappropriate.
You agree to review stories before relying on them with a child and to stop using or report content that seems unsafe, inappropriate, or infringing. Moli is not medical, therapeutic, educational, legal, or professional advice.
7. Voice cloning and recordings
Voice cloning is optional and available only where enabled for eligible subscribers. You may upload or record a voice only if you have all rights and permissions required to do so. You may not upload a child's voice, another person's voice without authorization, or any recording that violates law or another person's privacy or publicity rights.
By using voice cloning, you authorize Moli and its voice providers to process the recording to create, store, use, and delete a voice profile for narration. You are responsible for how cloned voices are used through your account.
8. Subscriptions, trials, and payments
Some Moli features require a paid subscription. Subscriptions are purchased through Apple's in-app purchase system and are billed by Apple to your Apple ID. Apple handles payment, renewal, cancellation, refunds, taxes, and payment-related support under Apple's terms and policies.
Unless you cancel at least 24 hours before the end of the current billing period, subscriptions may renew automatically. You can manage or cancel subscriptions in your Apple account settings. Removing the app does not cancel a subscription.
We may change free-tier limits, Pro features, pricing, trials, or subscription offerings as permitted by Apple and applicable law.
9. Acceptable use
You agree not to:
- use Moli for unlawful, harmful, deceptive, abusive, or exploitative purposes;
- submit prompts or content involving sexual content, exploitation, hate, harassment, self-harm, graphic violence, or unsafe instructions;
- attempt to bypass safety filters, consent gates, rate limits, subscriptions, or access controls;
- reverse engineer, scrape, overload, interfere with, or disrupt the Service;
- upload malware or attempt unauthorized access to systems or data;
- use Moli to infringe intellectual property, privacy, publicity, or other rights;
- resell, sublicense, or commercially exploit Moli or generated content without our written permission.
10. Suspension and termination
You may stop using Moli at any time and may delete your account in the app. We may suspend or terminate access, remove content, or limit features if we reasonably believe you violated these Terms, created safety risk, caused harm, failed to pay fees, or if we must do so for legal, security, or operational reasons.
Sections that by their nature should survive termination will survive, including ownership, licenses, acceptable use, disclaimers, limitations of liability, indemnity, and dispute terms.
11. Third-party services
Moli may rely on third-party services, including Apple, Google, hosting providers, payment systems, AI providers, and voice providers. Their services may be governed by their own terms and privacy policies. We are not responsible for third-party services that we do not control.
12. Indemnity
To the fullest extent allowed by law, you agree to indemnify and hold harmless Moli, ExceedX AI, and our owners, officers, employees, contractors, agents, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your use of the Service, your User Content, your violation of these Terms, or your violation of another person's rights or applicable law.
13. Disclaimers
To the fullest extent allowed by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service or generated content will be accurate, safe in every situation, uninterrupted, secure, or error-free.
14. Limitation of liability
To the fullest extent allowed by law, Moli, ExceedX AI, and our owners, officers, employees, contractors, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, service interruption, or substitute services.
To the fullest extent allowed by law, our total liability for all claims relating to the Service or these Terms will not exceed the greater of the amount you paid to Moli through Apple for the Service in the three months before the claim arose or one hundred U.S. dollars (US $100).
15. Governing law and disputes
These Terms are governed by the laws of the State of California, excluding conflict-of-law rules. You and Moli agree to the exclusive jurisdiction and venue of the state and federal courts located in California for disputes that are not required to be handled elsewhere by applicable law.
16. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will provide notice as appropriate, such as in the app, on the website, or by email. Continued use of the Service after updated Terms become effective means you accept the updated Terms.
